Introduction
This article forms part of MDCO’s Low-Frequency Noise (LFN) series (→A09 Understanding Low-Frequency Noise from Data Centres) and examines how European planning and legal systems have responded to persistent low-frequency noise through a series of influential case studies.
The previous article in this series, → A09.01 Why Low-Frequency Noise Becomes a Community Conflict, examined four recent case studies from the United States to illustrate how persistent low-frequency noise has increasingly become the subject of community disputes, private litigation and broader public debate surrounding data centre development. Although each case arose within a different factual context, they collectively demonstrated that concerns about low-frequency noise rarely remain confined to engineering alone. Instead, they often expand into questions of planning, governance, property rights, public health research and community trust.
Europe presents a markedly different pattern.

This article therefore examines several representative European case studies to explore how low-frequency noise has evolved into a planning, environmental and human rights issue. Together with the United States experience examined in →A09.01, these cases illustrate two complementary governance approaches to managing one increasingly important environmental challenge.

Four European Case Studies
Unlike the United States cases examined in →A09.01 Why Low-Frequency Noise Becomes a Community Conflict, which largely involved recent disputes surrounding hyperscale data centres, Europe’s most influential legal developments concerning low-frequency noise have arisen across a broader range of infrastructure sectors.
This reflects the relative maturity of European environmental law. Long before hyperscale data centres became widespread, European courts and regulators had already been required to consider how persistent environmental noise should be assessed, how communities should participate in planning decisions, and how governments should balance infrastructure development against environmental protection.
For this reason, the following case studies are not intended to compare technologies. Rather, they examine how European legal principles relating to low-frequency noise have evolved through different forms of infrastructure that present similar governance challenges.
Together, these cases illustrate how environmental noise can become an issue of planning, administrative law, environmental assessment and, in some circumstances, human rights.
Case 1 — Belgium: When Noise Standards Became a Governance Issue
Background
One of the most influential European judgments relating to environmental noise did not concern the operation of an individual project, but the legal framework governing how projects should be assessed.
The dispute arose in Belgium following the adoption of regional regulations governing wind turbine developments in Wallonia. These regulations established various planning and environmental requirements, including provisions relating to permissible operational noise levels.
A group of residents challenged the legality of these regulations, arguing that they should have been subjected to a Strategic Environmental Assessment (SEA) before adoption, as required under European Union law.

In Fägerskiöld v Sweden, two residents living near a wind turbine alleged that operational noise and shadow flicker interfered with the peaceful enjoyment of their home, arguing that this infringed rights protected under Article 8 of the European Convention on Human Rights. They also relied on Article 1 of Protocol No. 1 concerning the peaceful enjoyment of possessions.
Although the project involved renewable energy rather than data centre infrastructure, the legal principles considered by the Court have broader relevance to any major development capable of generating persistent environmental noise.
The Court’s Consideration
The European Court of Human Rights accepted that environmental noise may, in principle, affect rights protected under Article 8 where the interference reaches a sufficient level of seriousness.
The Court therefore recognised that environmental noise is capable of engaging human rights considerations under appropriate circumstances.
However, after reviewing the evidence presented, the Court concluded that the applicant had not demonstrated an interference sufficiently severe to establish a violation in the particular circumstances of the case.
The application was therefore declared inadmissible.
Why the Case Remains Important
Although the applicant did not succeed, the significance of the judgment lies elsewhere.
The Court acknowledged that persistent environmental noise may affect the enjoyment of one’s home and, in appropriate cases, may require balancing between private rights and wider public interests.

Case 3 — Ireland: When Regulatory Compliance Did Not End Private Nuisance Claims
Background

Two recent Irish High Court decisions have become particularly significant in this regard: Webster & Rollo v Meenacloghspar (Wind) Ltd, concerning the Ballyduff Wind Farm in County Wexford, and Byrne & Others v ABO Wind Ireland Ltd, concerning the Gibbet Hill Wind Farm.
In both cases, nearby residents alleged that the continuing operation of wind turbines generated persistent environmental noise, including low-frequency characteristics and amplitude modulation, that disrupted daily life and the peaceful enjoyment of their homes.
Unable to resolve these concerns through other means, the residents commenced proceedings alleging private nuisance.
Court Findings
In Webster, the High Court concluded that the operational noise constituted an actionable private nuisance.
Importantly, the Court held that compliance with planning permission and applicable regulatory requirements did not, by itself, prevent neighbouring residents from pursuing a private nuisance claim where substantial interference with residential enjoyment was established on the evidence.
In Byrne, the High Court likewise found in favour of affected residents, awarding damages and granting injunctive relief requiring operational restrictions to reduce the continuing nuisance.
Together, the judgments demonstrate that private law remedies may remain available even where infrastructure has been lawfully approved and is operating within an established regulatory framework.
Broader Significance
The Irish experience demonstrates that planning approval and regulatory compliance do not necessarily conclude disputes concerning low-frequency noise.
Public regulation and private law perform different functions.
Planning systems determine whether a development may proceed in the public interest, while the law of private nuisance protects neighbouring landowners from unreasonable interference with the use and enjoyment of their property.
Accordingly, compliance with one framework does not automatically preclude claims arising under the other.

The absence of major European data centre noise litigation should not be interpreted as evidence that low-frequency noise is unimportant.

Several European judgments did not conclude that environmental standards had necessarily been breached. Instead, courts considered whether planning authorities had properly assessed environmental effects, whether existing standards were legally established or whether individual rights had been appropriately balanced against wider public interests.
In neither legal system does regulatory compliance automatically conclude public debate.

This difference does not imply that one approach is inherently superior.
Meaningful public engagement can be challenging regardless of when it occurs. Early consultation may not eliminate future disagreements, while post-construction engagement may still produce valuable engineering improvements and stronger community relationships.
Nevertheless, the comparison suggests that governance frameworks may benefit when community perspectives are considered throughout the entire project lifecycle rather than only after concerns become established.

Governance Must Continue to Evolve
Perhaps the most important lesson emerging from both the United States and European experiences is that governance frameworks continue to evolve alongside technology.
Many environmental noise regulations were originally developed for conventional industrial facilities, transport infrastructure or earlier generations of energy systems.
Modern hyperscale data centres introduce new engineering characteristics.
Continuous twenty-four-hour operation.
Large cooling systems.
Rapid expansion in computing capacity.
Artificial intelligence workloads.
Increasing electrical demand.
These developments raise legitimate questions regarding whether existing planning frameworks, environmental assessment methodologies and acoustic standards remain fully suited to emerging forms of digital infrastructure.
Importantly, none of the cases reviewed suggests that current governance systems have failed entirely.
Instead, they illustrate that governments, regulators, operators, communities and courts continue adapting existing legal frameworks as technologies evolve.
The ongoing refinement of environmental governance should therefore be viewed as a normal characteristic of modern infrastructure development rather than evidence of institutional failure.

Complementary Rather Than Competing Models
It may be tempting to compare the United States and European experiences by asking which governance model is “better.”
Such a conclusion would oversimplify a far more complex reality.
The United States has demonstrated how private litigation can provide communities with mechanisms for challenging operational impacts after facilities commence operation.
Europe has demonstrated how environmental assessment, planning law and administrative review may identify and address potential concerns earlier in the development process.
Both approaches possess strengths.
Both have limitations.
Both continue to evolve.
Rather than viewing these models as competing alternatives, they should be understood as complementary examples of how different legal systems seek to balance critical infrastructure development with environmental protection, community wellbeing and public confidence.
For countries experiencing rapid expansion of hyperscale data centres, including Malaysia, the more valuable lesson is not which system should be copied, but what each system can teach about improving transparency, accountability and informed decision-making.

This multidisciplinary character mirrors one of the central themes introduced in →A09 Understanding Low-Frequency Noise from Data Centres: complex infrastructure issues rarely belong to a single discipline. They emerge through the interaction of engineering, governance, law, environmental science and human experience.
From Noise to Governance
One of the clearest observations arising from the European experience is that legal disputes often begin long before any allegation of excessive operational noise.
Several of the cases reviewed focused instead on whether governments had followed appropriate planning procedures, whether environmental assessments had been properly conducted or whether regulatory frameworks themselves had been established in accordance with European environmental law.
This reflects a distinctive governance philosophy.
Rather than viewing environmental noise solely as an operational issue to be managed after construction, many European legal frameworks seek to address potential impacts during policy development, planning approval and environmental assessment.
Consequently, disputes often concern how decisions are made as much as what decisions are ultimately reached.
Communities may accept that infrastructure is necessary while still questioning whether sufficient environmental assessment has been undertaken or whether opportunities for meaningful participation have been provided.
This broader procedural focus differs from many recent United States disputes, where legal proceedings have more commonly followed the commencement of operations after residents experienced ongoing environmental impacts.
Neither approach eliminates conflict entirely.
However, they illustrate different ways in which governance systems attempt to manage uncertainty surrounding complex infrastructure projects.

Low-Frequency Noise as a Multidisciplinary Issue
Another recurring theme is the wide range of disciplines that become involved once low-frequency noise enters the public domain.
Engineers examine the design and operation of cooling systems, fans, compressors and other mechanical equipment.
Acousticians investigate sound propagation, frequency characteristics and measurement methodologies.
Environmental scientists assess broader environmental impacts and cumulative effects.
Lawyers examine planning legislation, environmental law, administrative procedures and private legal rights.
Public authorities consider regulatory compliance, environmental assessment and land-use planning.
Communities contribute lived experience regarding the practical consequences of nearby infrastructure.
No single perspective is sufficient on its own.
Engineering analysis can explain how sound is generated.
Acoustic measurements can quantify environmental conditions.
Environmental law can establish governance procedures.
Planning systems can determine where infrastructure should be located.
Human rights jurisprudence can recognise broader societal interests.
Yet none of these disciplines alone provides a complete understanding of why community conflicts arise or how they should be managed.
The European cases consistently demonstrate that effective governance depends upon integrating these complementary perspectives rather than treating each discipline in isolation.

The Importance of Public Trust
The cases reviewed also demonstrate that public trust occupies a central position within environmental governance.
Several disputes did not arise solely because communities questioned engineering conclusions.
Rather, they reflected broader concerns regarding transparency, consultation, procedural fairness and confidence in institutional decision-making.
Where communities believe that environmental assessments have been undertaken openly, scientific evidence has been carefully considered and opportunities for meaningful participation have been provided, disagreements may still occur. However, the discussion is more likely to remain focused on evidence and practical solutions.
Conversely, where planning decisions are perceived to lack transparency or where communities feel excluded from decision-making, environmental concerns may become intertwined with broader questions of governance and institutional accountability.
Public trust therefore cannot be viewed as separate from technical assessment.
Instead, it forms an essential component of effective environmental governance.
This observation is equally relevant to emerging digital infrastructure.
As hyperscale data centres become larger, more numerous and increasingly integrated into urban environments, maintaining public confidence will depend not only on engineering performance but also on transparent communication, meaningful engagement and responsive governance.

Implications for Future Data Centre Development
Although relatively few European legal disputes have so far centred specifically on low-frequency noise from data centres, the legal principles examined throughout this article are likely to become increasingly relevant as hyperscale infrastructure continues to expand.
Artificial intelligence computing is driving larger facilities, higher electrical demand and increasingly sophisticated cooling systems.
Many of the governance questions already encountered in relation to wind energy and other continuously operating infrastructure may therefore become more prominent within future data centre planning.
These questions include:
- How should potential low-frequency noise be assessed during planning?
- When should cumulative acoustic impacts be considered?
- How should communities participate in environmental decision-making?
- How should regulators balance digital infrastructure needs with residential amenity?
- How should governance frameworks evolve as technologies change?
None of these questions has a single universally applicable answer.
However, the European experience demonstrates that governance systems can evolve alongside technological development through continuous review of planning policies, environmental assessment procedures and regulatory frameworks.
For countries such as Malaysia, where hyperscale data centre development remains relatively recent, these international experiences provide an opportunity to strengthen governance before conflicts become widespread.
Rather than adopting either the United States or European approach wholesale, policymakers may instead draw lessons from both systems while developing governance frameworks suited to Malaysia’s own legal, institutional and social context.

Why This Matters for Malaysia
Malaysia is currently experiencing one of the fastest expansions of hyperscale data centre development in Southeast Asia. New facilities are being proposed and constructed at an unprecedented pace, particularly in Johor, where digital infrastructure has become a major component of the state’s economic development strategy.
At present, relatively few publicly reported disputes concerning low-frequency noise from Malaysian data centres have emerged. This should not, however, be interpreted as evidence that the issue will never arise.
International experience suggests that community concerns relating to low-frequency noise often become more prominent as data centre clusters expand, facilities operate continuously over longer periods and residential communities become increasingly integrated with major digital infrastructure.
The experiences examined in both →A09.01 Why Low-Frequency Noise Becomes a Community Conflict and this article demonstrate that different jurisdictions have responded to similar concerns through different governance pathways. The United States has largely illustrated how disputes may develop after facilities commence operation, while Europe has generally placed greater emphasis on planning, environmental assessment and public participation before projects proceed.
Neither approach should be viewed as a model to be adopted without careful consideration.
Malaysia possesses its own legal framework, planning system (→A09.04 Data Centre Low Frequency Noise in Planning Approval by Local Councils), environmental legislation and institutional arrangements. These differ significantly from those found in both the United States and Europe. Consequently, the objective is not to replicate foreign approaches but to understand the principles that underpin them and consider how those principles may inform future governance within the Malaysian context.
Several broader observations emerge.
First, international experience consistently demonstrates that low-frequency noise is rarely resolved through engineering alone. Effective equipment design and acoustic mitigation remain essential, but they operate within wider systems of planning, environmental assessment, regulation and community engagement.
Second, community confidence depends not only on whether infrastructure complies with technical requirements, but also on whether planning processes are perceived to be transparent, evidence-based and responsive to legitimate public concerns.
Third, governance frameworks should not remain static. As data centres become larger, artificial intelligence drives increasing computing density and cooling technologies continue to evolve, planning policies, environmental guidance and technical standards may also require periodic review to ensure that they remain appropriate for emerging forms of infrastructure.
Perhaps most importantly, international experience demonstrates that early understanding is considerably more valuable than reactive intervention.
Many of the governance challenges discussed throughout this series emerged only after communities, operators and regulators encountered unfamiliar situations for which existing frameworks had not been specifically developed.
Malaysia therefore has an opportunity to learn from international experience while data centre development is still expanding, rather than waiting until similar disputes become more widespread.
This is consistent with one of MDCO’s central objectives: reducing information asymmetry before misunderstandings become entrenched.
Improving public understanding does not eliminate disagreement, nor does it predetermine particular policy outcomes. Instead, it provides a stronger foundation upon which engineers, regulators, operators, policymakers and communities can engage in more informed and constructive discussion.

Throughout the Low-Frequency Noise (LFN) Analyse Series, MDCO has emphasised that persistent environmental noise cannot be understood through engineering alone.

This article has examined a complementary European perspective.
Rather than focusing primarily on post-construction legal disputes, European experience demonstrates how low-frequency noise has increasingly become integrated into planning law, environmental assessment, administrative governance and, in some circumstances, human rights jurisprudence. The emphasis is often placed on anticipating and managing potential impacts before they become entrenched community conflicts.
Taken together, these two articles do not suggest that one governance model is preferable to another.
Instead, they demonstrate that different legal systems have developed different mechanisms for addressing similar environmental challenges. Both continue to evolve alongside technological development, scientific understanding and changing public expectations.
For Malaysia, the most valuable lesson is not which system to emulate, but how both experiences reinforce the importance of transparent governance, evidence-based decision-making and meaningful engagement between all stakeholders.
As hyperscale and artificial intelligence infrastructure continue to expand worldwide, low-frequency noise is likely to remain an important public-interest issue.
Understanding it therefore requires not only better engineering, but also better governance, clearer communication and a willingness to integrate knowledge across multiple disciplines.
This multidisciplinary perspective lies at the heart of the Malaysia Data Centre Observatory.
